MIDDLEBURG – A Snyder County man, declared a sexually violent predator, will not be allowed to withdraw from his plea agreement. District Attorney Mike Piecuch says the Pennsylvania Superior Court ruled against Darion Levanowitz, who is charged with unlawful sexual activity with a minor on two separate occasions in 2013.
Piecuch says he obtained a legal ruling from President Judge Michael Hudock that evidence of Levanowitz’s prior sexual crimes against another minor in 2011 would be admissible, if the current case went to trial. Levanowitz accepted a plea agreement for statutory sexual assault and was sentenced to 33 months to 17 years in state prison.
Levanowitz later filed a motion to withdraw his plea and was denied on the county level, so he appealed to the Superior Court, who also denied his motion. (Ali Stevens)
